The HOA War

I mentioned earlier that I would expand upon the current issues with my Home Owner's Association (HOA).

My Man MitchThe situation started shortly after the Mitch Daniels for Governor campaign placed two campaign signs in my yard. As I opened the garage door to take the dog outside, I found the two signs lying in the driveway near the garage door. There were two possibilities: someone who didn't agree with my choice of political candidate had taken the signs down, or someone on the HOA board decided to enforce one of the covenant restrictions.

Either was possible, and neither more likely than the other, since it seems the current HOA Board doesn't spend much time enforcing the covenant restrictions. I placed the signs in the garage for a couple days while doing a little research.

I reread the covenants and toured the rest of the community. The covenant clearly states the following about signs:
No Sign of any kind shall be displayed to the public view on any lot, except that one sign of not more than six square feet may be displayed at any time for the purpose of advertising a property for sale, and except that Developer and its affiliates and designees, including the builders, may use larger signs during the sale and development of the subdivision.
This clause clearly put me in violation of the covenant restriction. It also put four other residents in violation for the display of campaign signs: one resident who also displayed a Mitch Daniels sign (which was also taken down) and three residents displaying signs for Barack Obama (which were not removed).

Having made a tour of the community and seeing the remaining Barack Obama signs, I decided to place one Mitch Daniels sign back in my yard, against a shrub in the landscaping in front of our house, exactly as one of the Obama signs was placed.

Wednesday night I returned home from work to find my replaced sign completely missing. I drove through the community and saw that all three Obama signs remained untouched. I obtained the email address of the president of our HOA from a friend who is on the HOA Board and sent her an email asking for an explanation.

In the three days that followed, we engaged in a volley of emails about the covenants, the signs that remain (and whether or not removing mine and leaving the Obama signs was politically motivated), and of the many other covenant violations that have gone unenforced (violations of fencing restrictions, yard maintenance, additional structures, debris, outside storage, and disabled vehicles, to name a few).

As of this evening when I returned home from work, the Obama sign placed in the landscape in the manner that I replaced my Mitch Daniels sign remains untouched. I will be attending the HOA meeting coming up this next week, where I will present my case before the full board and any other residents in attendance. My case that it is inappropriate to selectively enforce the covenants in such a manner as to appear that the enforcement is politically motivated. My case that it is inappropriate for anyone to sneak into my yard and steal away with the sign that was placed in my landscaping. My case that this neighborhood needs an HOA Board that is actually motivated to improve the community by enforcing the covenants as enacted, changing those that should be changed, and notifying residents about violations rather than secretly enforcing the restrictions.

Subdivisions, Covenants, and Politics


It's amazing how in this election cycle, we see politics in literally everything. I am currently engaged in a heated battle with my Homeowner's Association over the removal of some Mitch Daniels for Governor signs from my yard. More specifically, I'm in a heated battle with the President of my Homeowner's Association over the issue. The rest of the board hasn't been involved yet, other than receiving her forwarded emails.

I will address the issue formally at the next Homeowner's meeting, which I believe is scheduled for next week. I have decided to make it my personal mission to get onto this board, force the prima donnas off of it, and start doing what's best for the community.

I'll expand more on the issue this evening. Stay tuned.....

Vacation Winding Down -- Finally HOME

I've been on vacation since Decmeber 28 to pack up, load up, move, unload, unpack, clean up at the old house, and settle in to the new house. It hasn't been much of a restful vacation, and I've only got two days left of it before returning to work.

My wife's family has been by for a visit, as well as some of my family. We have most of the rooms unpacked and settled, while others (such as the office, where I'm writing this right now) still appear untouched. It's been ten days, but feels like it's only been two.

It's nice to be in our own home finally. Nice to be putting our money into an investment of our own rather than someone else's. Nice to no longer be throwing our money away in rent. And nice just to finally be HOME.

Moving Update

We made a huge improvement in the move today. Not having to run back and forth between the old house and new any longer was certainly a big help. We got all of the remaining furniture brought in from the garage today. That means there's nothing left to bring in and unpack but some boxes, and we could probably almost fit one of the cars in the garage soon.

Tomorrow we're expecting my wife's brother and his wife to stop by while they're in town for an appointment. Other than that, the day will be mostly devoted to bringing boxes in from the garage one at a time and unpacking them. My goal: to be pretty much settled in before the weekend.

Moving -- Update

So we're in our new home tonight. I posted frequent updates of the entire move process to Pownce and/or Twitter. If you're really interested in the struggle of one man to move his family half way across the state of Indiana (which isn't very far, really) in one day, you can check it all out there.

Basically, it took me nine hours to load the truck (five last night and four this morning), and I packed it as full as I could possible pack it. We left behind at the old house all of our outdoor furniture as well as several items inside the house that I'll be going to retrieve tomorrow while my wife continues to unpack in the new house.

After making the drive to Indy, it took me less than four hours to unload everything into the garage, where it's all staged to be brought into the house and unpacked in an orderly fashion. As orderly as my wife can manage, anyway. I haven't been able to reassemble our daughter's crib or put the couches back in place because my wife, who was put in charge of keeping track of the hardware for the items, either packed it away in an unknown box somewhere or left it behind, as well. So our daughter will be sleeping with us tonight.

Right now, I'm about worn out for the day. It's still early, really, and there's so much that could still be done tonight, but my body's telling me it's time to take it easy. I may listen, I may not.

Tomorrow I head north to Fishers, Indiana, to pick up a table that my wife found on Craigslist for our breakfast nook. Then it's back west to the old house to retrieve as much of what we left behind as possible. And, again, we'll be heading back west on Sunday (the entire family) to clean up the old place, hand over the keys, and go to church.

I've always hated moving, but this time, as much as I hate it, it's a great feeling to be moving into our own house. Now, I better get back downstairs and see if I can give my wife a hand.

Moving...

We're spending the weekend loading the truck, moving, unloading the truck, cleaning the old house, unpacking, and trying to get settled in to our new home. Though our Internet connection at the new home should be up and running this afternoon, things will probably be a bit quiet here for most of the day, and a good part of the weekend, I suspect.

Once I pack up the router, etc., which will probably be one of the last things to get packed, my only connection to the digital realm will be SMS posting via Twitter. Until then, I'll be putting progress updates in both Twitter and Pownce (more detailed).

The Average Joe Radio 1-year anniversary /SLASH/ New Year episode should (I hope) be posted on January 1, 2008 -- the actual anniversary date of the show -- from our new home.

Setting Up the Services

Spent the morning at work, in the office, calling to set up utilities in the new home. Loading up the truck begins tomorrow evening, and I hope to have everything unloaded and moved so I can return the truck Friday evening. Unpacking, on the other hand, will take a bit longer.

So I contacted all of the various utility companies that service the area. Electric, no problem. Water, no problem. There is no gas, which is definitely not a problem. The only area of choice in the utility business these days is in telecommunications -- phone, cable, internet.

My wife assembled a listing of various companies, and I began calling them. First on the list was SBC (formerly Ameritech, Southwestern Bell, or any one of probably a million other names they've used in the past). When I called the number listed online for SBC, I reached a company called White Fence. The agent described the company as a sort of broker of communications services that could set me up with service from any of the providers in the area. The first clue that you aren't dealing with the best person is when that person is a reseller of the service you are looking for. This White Fence agent told me that SBC was not available in our new area (Indianapolis), and that the only provider she listed that could offer all three services (phone, cable, and internet) to us was AT&T (which, of course, is formerly SBC). She offered me a package that included unlimited local and long distance phone service with "the ten most popular phone features," broadband internet with a 3 megabyte upload/download rate, and "the 100 most popular channels" from Dish Network, for $104.98 per month, including HBO and Cinemax for free for six months.

I have no desire to have HBO and Cinemax in my home, and a 3 megabyte upload/download rate would actually be a downgrade over our current service with Time Warner/Road Runner. I also have no desire to switch to satellite television service. They said they could upgrade me to 5 megabytes for $10 more per month, but dropping the satellite television from the deal would change my phone service from unlimited long distance to ten cents per minute.

I also called Brighthouse Networks, which is apparently a local provider of the same services. For $99 and change they can offer me a similar package with a 1.5 megabyte upload/download rate. Wow! At that speed, I might as well connect with NetZero or Juno dial up service for free. Could you imagine trying to host a podcast at that speed? They, too, could upgrade my speed for an additional $10 per month, but only to 3 megabytes.

I finally settled with Comcast. For $102 a month we have the most basic digital cable package available, broadband internet with a 6 megabyte rate, "unlimited" bandwidth (I'll be testing that one, for sure), and digital phone service with unlimited local and long distance service. And they can have everything hooked up the afternoon that we're moving into the house.

Anybody out there have any experience with Comcast internet and phone service?

Old Man Winter Cometh

The first flakes of snow fell upon Indianapolis this week, but they bypassed my home, about seventy miles west of Indy. I woke up on Tuesday and started my commute to work over dry roads, and pulled into a parking lot at work with about two inches of snow on the ground.

As the picture at left shows, I don't think the snow will be so forgiving this time. I live right on the eastern edge of the snow in this radar picture, right off of Interstate 70. The snow hasn't started falling yet, but the weatherman promises us two to three inches of snow accumulation by morning, as well as possibly a quarter inch of ice accumulation. Guess I'll be waking up early to see what Old Man Winter has delivered for me to tackle during my morning commute.

By the way, if you've been following my house hunt story lately, it looks like everything is a go. I just received word (as close to final as you can get) that we will be moving in just after the first of the new year. What a way to start the new year, in our very own home.
